Terms and Conditions

1. General

1.1 These Booking Terms and Conditions (Booking Terms) outline the terms and conditions under which Thirty-nine Alexander will take bookings and permit guests to stay at the Hotel.

1.2 Please read these Booking Terms carefully. You will be required to accept the Booking Terms prior to making a booking to stay at our Hotel. By accepting these Booking Terms, you agree to comply with, and will ensure that all guests in your party comply with, the Booking Terms.

1.3 We reserve the right to amend these Booking Terms at any time. Any varied Booking Terms will be published on our website.

1.4 If part or all of any clause of these Booking Terms is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Booking Terms and the remaining provisions of these Booking Terms will continue to have full force and effect.

2. Definitions

  • Australian Consumer Law means Schedule 2 to the Competition and Consumer Act 2010 (Cth).

  • Booking means a booking to stay at the Hotel.

  • Hotel means the accommodation hotel owned and operated by Thirty-nine Alexander and located at 39 Alexander St, Port Pirie SA.

  • Hotel Rules means the Hotel Rules available at www.39alexander.com.au and Hotel reception.

  • Thirty-nine Alexander, “we”, “us” or “our” means Thirty-Nine Alexander Pty Ltd ACN 689 373 797 ABN 67 689 373 797 of 39 Alexander St, Port Pirie SA 5540.

  • “you” or “your” means the person making the Booking and “your party” includes you and any other person(s) included in your Booking.

3. Booking Process

3.1 You can make a Booking online using our website, or in person at Hotel reception. Our Hotel may also be available for Booking through third party booking sites or online travel agents.

3.2 You will receive email confirmation once we have received and confirmed your Booking.

4. Privacy Policy

Our Privacy Policy, available at www.39alexander.com.au will apply in respect of any personal information we collect from you. Please read and familiarise yourself with this policy.

5. Rates and Payment

5.1 The rates displayed on our website are in Australian dollars and are inclusive of GST (unless expressly stated otherwise). The rates only become firm upon payment for the specified Booking.

5.2 The rates are based on the number of guests for the specified time period and length of stay as at the date and time quoted. Any changes to these variables may result in changes to the rates.

5.3 Payment in full is required for all Bookings at the time the Booking is made.

5.4 If you pay by Visa credit or debit card, MasterCard, Amex or Diners card, a card surcharge of 1.8–2.9 % will apply. We reserve the right to adjust or amend this surcharge, as our own merchant and banking fees are adjusted.

5.5 Any additional costs that you incur during your stay, which may include:
(a) if you purchase items from the fridge/mini bar or at Hotel reception;
(b) additional cleaning charge for excess cleaning.
(c) if you damage your Room or the Hotel facilities;
(d) if you smoke, vape or use illicit drugs in your Room.
(e) the cost of any call-out fee charged by the fire service, if you cause the fire alarm system to be triggered,
must be paid for in full on check-out. Where there are additional undeclared purchases or delayed charges (including through late processing or non-disclosure) we reserve the right to charge the credit card provided on check-in.

6. Changes or Cancellations to your Booking

6.1 If you wish to change your Booking, we will do our best to facilitate your request. However, you acknowledge and understand that this may not always be possible.

6.2 You acknowledge that, where you cancel or change your Booking, the following fees will apply:
(a) if you request a cancellation more than thirty (30) days in advance, no cancellation fee is payable and you will be entitled to a full refund of all amounts paid in advance;
(b) if you request a cancellation less than thirty (30) days, but more than seven (7) days, in advance, you will incur a cancellation fee of an amount equal to the first nights’ accommodation, per Room booked; and
(c) if you request a cancellation of less than two (2) days in advance, you will incur a cancellation fee equal to the full amount of the accommodation, per Room booked.

6.3 These cancellation fees reflect the reasonable, direct and indirect costs and time incurred or involved by us in providing booking services to you, as well as processing and managing the changes to, or cancellations of, your Booking.

6.4 Early departures or no shows (being when you do not check-in on the day of your Booking) will not be entitled to a refund or fee reduction.

7. Room Allocations and Changes

7.1 Whilst we will endeavour to accommodate special requests wherever possible- such as specific room numbers, bedding configurations, floor allocations or views, these requests will be subject to availability and the requirements of the Hotel.

7.2 You acknowledge that circumstances may arise which require us to change your Room, or relocate you during your stay. If this occurs, we will provide you with as much prior notice as possible and will endeavour to provide you with an alternative room of the same or similar standard to the Room you originally booked.

8. Check In/Check Out Requirements

8.1 Check- in is from 2:00 pm on your day of arrival and check out is strictly by 10:00 am on your day of departure.

8.2 Requests for an early check-in or late check-out will be subject to availability and are not guaranteed.

8.3 At the time of check- in, you agree to provide on request:
(a) a valid form of photo identification (such as a drivers licence or passport) so that we can verify your identify; and
(b) a credit card for pre-authorisation, which may be used to cover incidental items, any breakages or damage during your stay or additional cleaning charges. Where a credit card is not available, a minimum $500 cash deposit will be required.

8.4 You will be provided with one room key, which remains the property of the Hotel and must be returned on check-out. We reserve the right to charge a replacement key fee, if you lose or fail to return your room key, in consideration of additional costs we incur for replacing lost keys.

9. Hotel Rules

9.1 These Booking Terms operate in conjunction with the Hotel Rules and both the Booking Terms and Hotel Rules will apply to your stay. The Hotel Rules and other guidelines relating to your use of the Hotel are designed to ensure that our Hotel is maintained to a high-standard and so that all guests can enjoy a comfortable and peaceful stay with us.

9.2 You agree to comply with the Hotel Rules at all times during your stay, as well as any guidelines and signage displayed at the Hotel, and reasonable requests or directions from Hotel staff.

9.3 You acknowledge that failure to comply with the Hotel Rules may result in your immediate removal from the Hotel.

10. Liability

10.1 Your Booking and any other goods or services you purchase from us may be subject to certain laws, including statutory consumer guarantees that apply under the Australian Consumer Law. Nothing in these Booking Terms is intended to exclude or limit such guarantees.

10.2 To the extent permitted by law:
(a) we do not make any guarantees or warranties or make any representation of any kind; and
(b) all rights, remedies, conditions, guaranteed and implied and express warranties in respect of any goods or services provided by us are excluded.

10.3 You agree to release, indemnify and hold harmless Thirty-nine Alexander and its current and former officers, employees, contractors, sub-contractors/consultants (including their respective employees and contractors) and agents against, from and in respect of all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including but not limited to consequential and economic losses, property loss/damage and damages for injury, including personal injury and death) arising out of, caused by, attributable to or resulting from your Booking or your stay at the Hotel, except to the extent such expense, cost, liability, claim, action, proceeding, damage, judgement or loss arose out of, was caused by, attributable to or resulted from Thirty-nine Alexander’s negligence, wrongful act/omission or breach of these Booking Terms.

10.4 To the extent permitted by law, our total aggregate liability to you is limited to an amount not exceeding the amount paid by you for your Booking.

10.5 Each indemnity in these Booking Terms is a continuing and independent obligation and survives the termination or expiry of these Booking Terms.

11. Governing law

These Booking Terms are governed by the laws of South Australia, and you agree to submit to the exclusive jurisdiction of the courts of South Australia.

CANCELLATIONS AND NO SHOWS

1.1 You acknowledge that, where you cancel or change your Booking, the following fees will apply:
